ANALISIS DAMPAK KEBIJAKAN HAK KEKAYAAN INTELEKTUAL (HKI) TERHADAP KINERJA KERJA SAMA LISENSI BIDANG PERTANIAN

The objective of this study is to determine the impact of Intellectual Property Rights (IPR) policy on the cooperation performance of agricultural licensing. The result of the study shows that in the period of 2005-2015 the number of cooperation agreements conducted by IAARD were 140 cooperation consisting of Patents (63 agreements), PVT (53 agreements) and Trade Secrets (24 agreements). The work unit of IAARD which has done the most licensing cooperation is Indonesian Center for Agricultural Engineering Research and Development (ICAERD) of 27 licensing agreement, followed by Indonesian Center for Land Resources (25 licenses), Indonesian Center for Horticulture Research and Development (24 license), Indonesian Center for Food Crop Research and Development (18 license), Indonesian Center for Rice Research (14 licenses) and Indonesia Center for Estate Crop (13 licenses). The number of companies that have entered into licensing agreements are 37 companies with the highest number of commodities / problem areas of fertilizers and land resources, horticulture, food crops, plantations, agricultural mechanization and biotechnology. Up to 2015 IAARD manages the royalty of licensing cooperation of Rp. 3,515 billion. The work unit that contributes the largest royalty is Indonesia Research Institute for Spices and Medicine Rp. 2,246 billion, and followed by Indonesian Research Institute for Ornamental Crops Rp. 1.177 billion. Constraints faced in licensed cooperation among others are technological performance that is not ready to be developed, limited market, human resource capability in receiving knowledge transfer and regulation obstacles.
